Abstract
A historical review is made about the due process antecedents and the charters that characterized the feudal system, up to the Carta Magna and its subsequent consecrations. Some conclusions are extracted to clarify the notion of due process. Its double nature is studied as well as its doctrine trends. Its legal and jurisprudential application is analysed and the elements embraced by it are analyzed under the Constitution.
