Abstract

As a consequence of the growth in the frequency of navigation and the amount and value of the carriage cargo, the ship owners and agents involve in this activity needed to find options of protection against the perils of navigation and the high costs that the consummation of this perils imply. As a result of the above, the Protection and Indemnity clubs better know as P&I clubs, where created in order to protect the interests of the mentioned agents.

In the Colombian legal frame work, the activity of the P&I clubs has presented serious issues considering that the governmental entity which is in charged of the control of this kind of activities has prohibited the operation of these asso- ciations.

As a result of the above, the Colombian owners have found many difficulties in the practice of their activities, bearing in mind the importance of being a member of a P&I club, in order to be able to navigate around the world.
